Terms of sale

Placing an order for a product from the Gunnar.fr online catalogue is subject to the customer's full acceptance of the General Terms and Conditions of Sale set out below.

These General Terms and Conditions of Sale apply to the customer to the exclusion of all other conditions.

1. Acceptance

The customer's acceptance of these terms is evidenced by their electronic signature, confirmed by the "validation click" and by ticking the box "I have read the general terms and conditions of sale and accept them without reservation" during the order process. This electronic signature carries the same weight as a handwritten signature between the parties. This two-step process constitutes the customer's full acknowledgement and unreserved acceptance of all these terms and conditions.

2. Products

The presentation photographs illustrating the products offered in the Gunnar.fr electronic catalogue aim to describe and present items as accurately as possible. However, a supplier may make minor changes to a product, particularly to improve its quality. These photographs therefore cannot be considered part of the contractual scope, and minor variations in the representation of items shall neither engage the liability of Gunnar.fr nor affect the validity of the sale.

3. Availability

Our product offers and prices are valid while listed on the site and while stocks last. Information on product availability is provided to the customer at the time of placing an order. In the event of unavailability after an order has been placed, we will notify the customer by email and undertake either to provide replacement items of similar or superior characteristics and quality at an equal or higher price, or to issue a refund if the customer's bank account has been debited.

4. Order

Automatic recording systems are considered as proof of the nature, content and date of the order. Gunnar.fr confirms acceptance of the order to the customer at the email address provided. The sale is only concluded upon order confirmation. Gunnar.fr reserves the right to cancel any order from a customer with whom a dispute exists regarding payment of a previous order. Products can only be delivered to the delivery address provided by the customer during the order process. The information provided by the customer when placing an order is binding: in the event of an error in the recipient's details, the seller cannot be held responsible for any resulting failure to deliver the product.

In the event of an error — whether intentional or not — in the customer's name and/or delivery address that results in the parcel being returned to our depot (e.g. "Not Known at This Address"), Gunnar.fr reserves the right to ask the customer to cover the cost of returning the parcel to the warehouse as well as the cost of re-shipping it to the correct delivery address.

5. Delivery

Upon order confirmation, Gunnar.fr undertakes to hand over all items ordered by the buyer to its carrier. Orders are generally dispatched within 24 to 48 hours after order validation. Orders are processed Monday to Friday. They are then handed over to the carrier, and the carrier's own delivery timeframe applies thereafter. Please note: carrier delivery times are given as estimates and we cannot be held responsible for any delays on the carrier's part.

Orders are only handed to the carrier once complete. In the event of a partial shipment at the customer's request, shipping costs will be charged for each dispatch.

The customer must notify the carrier and Gunnar.fr of any reservations regarding the delivered product (damaged parcel, already opened, etc.) within 24 hours of receiving the product.

In the event of apparent defects, the customer has the right of return under the conditions set out in this document.

Furthermore, for deliveries outside mainland France, the customer agrees to pay all applicable import duties, customs duties, value-added tax, and any other taxes required under the laws of the country of reception.

We cannot be held responsible for delivery delays once the parcel has been handed to the carrier.

For purchases of €100 or more, delivery is free of charge. This applies to the following shipping method only: Standard. Express orders and orders destined for locations outside mainland France are excluded from this offer.

6. Force Majeure

The following are considered force majeure events releasing the seller from their delivery obligation: war, riot, fire, strikes, accidents and inability to obtain supplies. Goods always travel at the recipient's risk and expense. The customer is required to inspect their parcel upon arrival. They have 48 hours to lodge any reservations with the carrier in the event of missing items or damage.

7. Right of Withdrawal

If a delivered product does not fully satisfy the customer, they may return it to the operator. The customer has thirty (30) days from the date of receipt of the order to do so — excluding sale items or personalised products — for exchange or refund, with no penalty other than return shipping costs. Items must be returned by tracked Colissimo with acknowledgement of receipt. Returns must involve new items in their original packaging, complete with all accessories, instructions and documentation. To submit a product return request, please contact our After-Sales Service (SAV) at the address indicated on our Contact page. Incomplete, damaged or soiled items will not be accepted for return. In the event of abnormal or excessive returns, Gunnar.fr reserves the right to refuse a subsequent order. Where the right of withdrawal is exercised, Gunnar.fr is required to refund all sums paid by the customer, free of charge, with the exception of return shipping costs. The refund is due within a maximum of 30 days.

In accordance with Article L.221-21 of the French Consumer Code, and in order to exercise this right of withdrawal under the conditions of Articles L. 221-18 et seq., the customer is invited to contact Gunnar.fr.

Exception: By definition, the "GUNNAR RX — With prescription, Gunnar with corrective lenses" ranges (medical devices with corrective lenses, requiring a valid prescription and dispensed by a qualified optician) are highly personalised products (tailored to the customer's vision). As such, and pursuant to the exceptions set out in Article L.221-28 of the French Consumer Code, orders placed with Gunnar.fr cannot be subject to a return under the right of withdrawal applicable to online purchases.

By accepting these General Terms and Conditions of Sale, the customer expressly acknowledges having been informed of the withdrawal terms and conditions.

However, Gunnar.fr has a duty of effectiveness and offers an adaptation guarantee. In the event of visual discomfort, an exchange will be made upon return of the corrective eyewear.

8. Pricing

Prices are expressed in euros (€).

Prices listed on product pages do not include shipping.

The price charged to the customer is the price shown on the order confirmation sent by Gunnar.fr; it includes the price of the products and shipping costs.

Gunnar.fr reserves the right to modify prices at any time. However, for any accepted order, Gunnar.fr guarantees the prices applicable at the date of order confirmation by Gunnar.fr.

9. Payment

Products are paid for in euros by credit/debit card, PayPal, bank transfer, or via Alma. An order validated by the customer will only be considered final once the relevant banking payment centres have given their approval. In the event of a refusal by said centres, the order will be automatically cancelled and the customer notified by email. Furthermore, Gunnar.fr reserves the right to refuse any order from a customer with whom a dispute exists.

In the case of payment in instalments via Alma: if you pay for your order in instalments, you accept Alma's general customer terms and conditions as well as the specific Alma terms and conditions for Gunnar Optiks customers.

11. Intellectual Property

The site is the sole property of Gunnar.fr, along with all associated rights. All texts, works, illustrations and images reproduced on Gunnar.fr are protected by copyright and intellectual property law worldwide. Accordingly, and in compliance with the provisions of the French Intellectual Property Code, only use for private purposes is authorised, subject to any different or more restrictive provisions of said Code.

Any reproduction, in whole or in part, of the site is subject to prior authorisation from Gunnar.fr.

12. Liability

The products offered comply with French legislation in force and applicable standards in France. Gunnar.fr cannot be held liable for failure to comply with the legislation of the country to which the product is delivered. It is the customer's responsibility to check with local authorities regarding any restrictions on importing or using the products.

Gunnar.fr shall not be held liable for any damage whatsoever resulting from professional use (loss of business, loss of profit, currency losses, damages and costs).

In all cases, the customer benefits from the legal guarantee against eviction and hidden defects (Articles 1625 et seq. of the Civil Code), provided that the buyer proves the existence of the hidden defect. The seller is legally required to remedy all consequences thereof (Articles 1641 et seq. of the Civil Code). If the buyer takes legal action, they must do so within a "short period" from the discovery of the hidden defect (Article 1648 of the Civil Code).

The statutory guarantees of conformity and hidden defects do not in any way cover damage resulting from accidents, misuse or incorrect assembly, negligence, or significant alteration of the appearance or operation of the returned equipment.

We reserve the right to refuse any warranty return for a product damaged as a result of improper use.

13. Personal Data

The provision of personal information collected for the purpose of distance selling is mandatory, as this information is essential for processing and dispatching orders, issuing invoices and warranty contracts. Failure to provide this information will result in the order not being validated.

The customer has the right (Article 34 of the Act of 6 January 1978) to access, modify, rectify and delete their personal data, which they may exercise with Gunnar.fr.

Gunnar.fr undertakes not to disclose to third parties, whether for free or for consideration, the information provided by the customer. This information is confidential. It will only be used to process the customer's order and to enhance and personalise communications about products reserved for Gunnar.fr customers, in particular through Gunnar.fr newsletters to which the customer may have subscribed, and as part of personalising the site based on their interests.

Our site is also designed to best meet the needs of our customers, which is why we use cookies. These are intended to record the customer's visit to our site and are used by Gunnar.fr solely to improve the personalised service provided to the customer.

14. Disputes

This contract is governed by French law. Gunnar.fr cannot be held liable for damage of any kind — material, immaterial or physical — that may result from a malfunction or misuse of the products sold. The same applies to any product modifications made by manufacturers. Gunnar.fr's liability shall in all cases be limited to the amount of the order and cannot be engaged for simple errors or omissions that may have persisted despite all precautions taken in the presentation of the products. In the event of difficulties in the application of this contract, the customer may, before taking legal action, seek an amicable solution, in particular with the assistance of a professional industry association, a consumer association or any other adviser of their choosing. It is noted that pursuing an amicable resolution does not interrupt the "short period" of the statutory guarantee, nor the duration of the contractual guarantee. It is further noted that, as a general rule and subject to the courts' assessment, compliance with the contractual guarantee provisions of this agreement presupposes that the buyer honours their financial obligations to the seller.

Complaints and disputes will always be received with attentive goodwill, as good faith is always presumed on the part of anyone who takes the trouble to set out their situation. In the event of a dispute, the customer should contact the company in the first instance to seek an amicable resolution.
